Consumers can seek replacement, repair, or refund for products with manufacturing defects.

If you buy a product and it turns out to be defective, broken, or does not work as advertised, you have the right to demand a repair, replacement, or full refund from the seller or manufacturer. The Consumer Protection Act 2019 protects you even for online purchases. You can file a complaint in the Consumer Commission without needing a lawyer.
Step-by-Step Action Plan
Stop using the defective product immediately and keep it safely as evidence.
Contact the seller/manufacturer in writing (email or complaint letter) with proof of purchase, describing the defect.
Request a replacement, repair, or refund — give them 15-30 days to respond.
If they refuse or do not respond, file a complaint on the National Consumer Helpline portal (consumerhelpline.gov.in) or call 1800-11-4000.
File a formal complaint in the District Consumer Disputes Redressal Commission (for claims up to ₹1 crore), State Commission (₹1-10 crore), or National Commission (above ₹10 crore).

Section 2(10) — Defect, Section 39 — Filing of Complaint
"Defect means any fault, imperfection, or shortcoming in the quality, quantity, potency, purity, or standard which is required to be maintained by or under any law or any contract. A consumer may file a complaint regarding defects in goods or deficiency in services."
⚠️ Punishment / Penalty
The Consumer Commission can order replacement, removal of defect, refund of price, and compensation for loss or injury suffered. Additionally, punitive damages may be awarded for negligence.
