Protection Against Overcharging and MRP Violations
No seller can charge more than the Maximum Retail Price (MRP) printed on the product.
🗣️ What this means for you
It is illegal for any shop, restaurant, multiplex, or seller to charge you more than the MRP printed on a product. The MRP includes all taxes. If a restaurant charges above MRP for bottled water or a shop charges extra on packaged goods, you can refuse to pay and file a complaint.
Step-by-Step Action Plan
Check the MRP on the product packaging and compare it with the price charged.
Take a photo of the product with MRP and the bill showing the overcharge.
Bring it to the seller's attention — demand correction on the bill.
If the seller refuses, file a complaint with the Weights and Measures Department (Legal Metrology) of your state.
You can also file a consumer complaint in the Consumer Commission.
Report overcharging at movie theatres and airports to the respective regulatory authority.
⚖️ The Relevant Law
Legal Metrology Act, 2009 (2009)
Section 18 and Rule 6 of the Legal Metrology (Packaged Commodities) Rules, 2011
"No retail dealer or other person shall sell any pre-packed commodity at a price exceeding the retail sale price (MRP) printed on the package. The MRP declared shall include all taxes."
⚠️ Punishment / Penalty
Fine up to ₹25,000 for the first offence. For subsequent offences, fine up to ₹50,000 or imprisonment up to 1 year or both. The Consumer Commission can also order a refund of the excess amount.
