Right to Warranty and Guarantee

Manufacturers must honor the warranty period and terms printed on the product or promised at the time of sale.

🗣️ What this means for you

If a product comes with a warranty, the manufacturer or seller must repair or replace it free of cost during the warranty period. They cannot refuse warranty service by citing minor issues or claiming "physical damage" without proper inspection. Even if you have lost the warranty card, your purchase bill serves as proof of warranty.

Step-by-Step Action Plan

1

Check your warranty terms — the warranty card, product manual, or the company website.

2

Contact the authorized service center or the seller with the product and proof of purchase.

3

If warranty service is refused, get the refusal in writing and ask for the specific reason.

4

File a written complaint with the company's customer support and escalate to the nodal officer.

5

File a complaint in the Consumer Commission if the company refuses to honor warranty.

6

Even without a warranty card, your purchase invoice serves as proof — carry it to the service center.

⚖️ The Relevant Law

Consumer Protection Act, 2019 (2019)

Section 2(9) — Definition of Complaint, Section 39

"A consumer complaint may allege that goods bought suffer from defects, or that services are deficient, or that the opposite party has not complied with the terms of warranty or guarantee. The Consumer Commission may direct the opposite party to replace goods or provide appropriate relief."

⚠️ Punishment / Penalty

The Consumer Commission can order free repair/replacement under warranty, refund if repair is not possible, and additional compensation for harassment and mental agony.
